About these terms

These Website Terms apply to your use of the ERC Contracting website. They explain what the website is for, how enquiries are treated, and what limits apply to reliance on website content.

They govern the website only. They do not set the scope, price, programme or payment terms of any project. ERC may update these Website Terms by publishing a new version on this page. The date above will change when that happens.

Website information

Information on this website is general information about ERC Contracting and the kinds of work ERC undertakes in Auckland. It is not professional, legal, programme or pricing advice. It is not a statement that ERC can or will undertake a particular project.

Project conditions, scope and availability change. You should not rely on website content as a substitute for a written quotation or project agreement. ERC may update or remove content as services and projects change.

Enquiries and quotations

Submitting an enquiry does not oblige ERC to provide services and does not create a construction contract. A contract arises only when the relevant quotation or agreement is accepted in accordance with its terms.

No quotation or construction contract

Nothing on this website is an offer to carry out construction work, or an invitation that by itself creates a contract. Service descriptions, project examples, photographs and the contact form are not quotations.

A quotation is a separate written document. A construction contract is formed only when that quotation or another written agreement is accepted in accordance with its terms.

Separate project terms

Any quotation, proposal or project undertaken by ERC is subject to the scope, pricing, programme, payment terms and other commercial terms contained in the applicable quotation, accepted Terms of Trade or other written agreement.

Website content does not replace those project-specific documents. If there is any inconsistency between this website and an accepted quotation or project agreement, the accepted project agreement applies to the relevant work.

Service descriptions

The website describes three areas of work: commercial fitout and installation, strip-out and demolition, and construction labour hire. Those pages explain the kind of work ERC undertakes.

They do not promise that every described capability is available on every project, and they do not fix the scope of any engagement. The scope of work is the scope set out in the applicable quotation or project agreement.

Project information and photography

Project pages show examples of work ERC has carried out. Photographs, captions and descriptions are for information. They do not mean ERC offers the same scope, programme, price or result on another project.

Site conditions, design, client requirements and the role of other contractors differ from job to job. A photograph may show work in progress, a completed area, or work alongside other trades. It is not a complete record of a project and it is not a warranty of a particular finish.

Intellectual property

Unless a page says otherwise, ERC Contracting owns the copyright in this website’s design, text and project photographs, or uses them with permission. You may view the website and print or download extracts for your own internal reference to ERC’s work.

You may not copy, republish or use the photographs, text, or ERC name and logo for another business, tender or publication without ERC’s prior written consent. Nothing on this website transfers intellectual property in drawings, specifications or other project documents supplied by a client or another contractor.

Acceptable use

You may use the website to read about ERC’s work and to make a lawful enquiry. You must not attempt to interfere with the website, probe or overload it, introduce malicious code, or scrape it in a way that degrades the service. You must not use it to send unlawful, misleading or abusive material, or misrepresent who you are when you contact ERC.

Third-party links and services

Email and telephone links open your own mail or phone application. The Privacy page names the providers this website actually uses.

The enquiry forms on this website send enquiries to Formspree, which processes them on behalf of ERC. Sending an enquiry does not create a construction contract. Formspree operates that delivery service under its own terms.

A link does not mean ERC endorses the other site or service. ERC is not responsible for third-party content or practices once you leave this website.

Website availability

ERC aims to keep the website available. It does not guarantee that the website will be uninterrupted, error-free or free of harmful components. ERC may change, suspend or withdraw any part of the website.

Limitation of liability

The website is provided for general information. To the extent permitted by New Zealand law, ERC Contracting is not liable for loss or damage arising from use of, or reliance on, the website, including loss arising from an error, omission, interruption or unavailability.

This limit does not apply to liability that cannot be excluded or limited under the Fair Trading Act 1986, the Consumer Guarantees Act 1993 where that Act applies, or any other New Zealand law. It does not exclude liability for fraud, or for personal injury or death caused by ERC’s negligence.

Nothing in these Website Terms limits rights or obligations under a quotation, accepted Terms of Trade or other written project agreement. Those documents govern the relevant work.

Privacy

ERC Contracting handles personal information in accordance with the Privacy page. That page explains what this website collects and how to ask for access or correction.

Governing law

These Website Terms are governed by New Zealand law. The courts of New Zealand have jurisdiction over disputes about these Website Terms, except where a New Zealand law gives you a right that cannot be limited by this clause.
